The platform InTribunale.com (hereinafter referred to as PF) has been conceived and developed to facilitate the profession of lawyers by the social promotion association know (hereinafter referred to as APS), which is the administrator (hereinafter referred to as AM).
2. FUNCTIONING
a) The following conditions govern the functioning relationship of PF with users, where user refers to anyone registered on the portal, who, by registering and creating an account, accepts the rules of PF.
b) The services offered are briefly explained on the website's homepage and in the Guide and FAQ section.
c) By accepting this information, users, through a click of acceptance, declare that they have understood the functioning of the offered services and, by entering their data and confirming the registration, commit to respecting the terms of use, accepting the privacy policy and the cookie policy, which they declare to have read.
3. REGISTRATION
a) User registration and the creation of a basic account are free and can be canceled by the user or by the AM of PF, who reserves the right to modify these conditions at any time. Access and use of the services after the publication of the modifications will constitute the express acceptance of the changes.
b) The user declares that the data entered during the registration phase is truthful, aware of the consequences in case of false declarations, for which the AM is not responsible. Therefore, the AM reserves the right to suspend or delete the user's account from the database if untrue data is discovered.
c) Users are required, at any time, even at the mere request of the AM, to provide their personal details, producing a copy of a valid identity document, and are obligated to keep their access data confidential. They cannot transfer, transfer, or communicate their access data to third parties, and they are responsible for any damages caused by improper use.
d) The AM reserves the right to delete or block access to a user for reasons it deems appropriate, also inhibiting the creation of a new account.
4. SUBSCRIPTIONS
a) The user may choose to subscribe to levels other than the basic free one, which allows the use of advanced services. This requires the payment of a periodic contribution, which is non-refundable even if the user decides to delete their PF account or does not use the activated services.
b) A payment receipt for the amount contributed can be downloaded within the user's reserved area.
c) To continue using the activated services, the user must renew the subscription within the time period by making the corresponding payment. Otherwise, it will be considered that they have chosen to maintain the free basic level.
d) The user is aware and declares to have understood that PF creates and facilitates new opportunities for professional collaboration but does not guarantee the successful outcome of these opportunities, as they depend on various factors and variables related to the normal supply and demand dynamics. Therefore, the user cannot claim the lack of receipt of requests or the assignment of tasks as they are determined by the free choice of other users, which the AM cannot influence and is not responsible for.
5. ASSIGNMENT OF TASKS
a) Each user is required, in using the services, to comply with the regulations provided by the professional code of the relevant professional category and to use the services appropriately for the purposes envisaged by PF. The user accepts the sanction of suspension, blocking, or deletion of the account in case of improper use, incompatible use, or any harm caused to other users.
b) The publication of a task, the application, and the payment are done through an intuitive procedure that the user declares to have understood and accepted.
c) Each task is filtered by an algorithm that utilizes AI and is displayed via email or within the user's reserved area.
d) The AM reserves the right to delete or modify the content of incorrect, incongruous, or offensive tasks.
e) The urgent task service involves an immediate assignment procedure without application to referenced lawyers registered on specific lists, which requires the payment of a periodic contribution.
f) The AM reserves the right to modify the procedures related to the publication, application, and payment for a task and the amount of the contribution. Access and use of the service after the publication of the modifications will constitute the express acceptance of the changes by the user.
g) Each user is solely responsible for the data and skills declared in the published task and offered application, the indicated fees, and the conduct maintained with other users during the professional collaboration. The AM is not responsible in any way or for any reason.
6. RESPONSIBILITIES AND COMPLAINTS
a) PF has been developed to create job opportunities, facilitate the demand and supply of services among professionals. The AM is not responsible for the unlawful and negligent behavior of users and reserves the right to suspend or delete the user's account who contravenes the rules mentioned here or any legal or common-sense norms, upon notification or ex officio. Therefore, the AM cannot be held liable for the negligent behavior of the user or external third parties to PF for any malfunctions. Consider that, for the latter hypothesis, there is a support service that, upon request, intervenes to resolve any technical issues.
b) Given the nature and purposes of PF, the AM abhors any form of dispute or controversy. In the regrettable event of any action or dispute arising from the interpretation or execution of these terms of use related to PF, the competent authority will be exclusively the Court of Trapani, after the mediation procedure has been completed.
c) The user acknowledges and accepts that if they intend to bring an action or dispute against the AM of PF, they will not make any financial claims or claims for any form of damages.
7. DATA PROCESSING - INFORMATION AND CONSENT
a) All those who register with PF accept and provide consent for the processing of the personal data entered for the indicated purposes and according to the regulations illustrated below. APS is the data controller to whom users can address any requests through the contact section.
b) User data is collected by filling out forms requesting name, surname, address, phone number, tax code, and email. This data is used solely to execute the service and potentially for commercial and non-commercial communications that the AM reserves the right to carry out in appropriate forms.
c) By registering, users accept the general conditions, accessing or using the services offered by PF, and declare that they have been informed according to Art. 13 of Legislative Decree 196/2003 and the privacy policy, as well as Art. 13 of European Regulation 679/2016, and accept the conditions established therein. The user's data is stored in a database that guarantees technical and structural measures to maintain its integrity.
d) Providing data is optional, but any refusal by the user will make it impossible to execute the service. The data is processed in compliance with legal, contractual, and regulatory obligations. The registration and processing of data occur electronically, ensuring security and confidentiality. The data provided by the user is communicated and used exclusively by the Data Controller and any appointed companies responsible for processing. The obtained data is appropriate, relevant, and not excessive concerning the scope, purposes, and specific, explicit, and legitimate services of the AM. Likewise, the user expressly consents to their data being transferred to other entities with the same purposes or to those replacing the AM in managing PF.
e) The processing of data will last no longer than necessary to fulfill the purpose of the collection, such as storing search criteria, notifications, publishing announcements, and contacting companies. The processing will continue until the data subject or the Data Controller decides to delete the entered data.
f) The user has the right to obtain confirmation of the existence or absence of personal data, as well as to know the origin of the data, the logic, purposes, and methods on which the processing is based, and the identification details of the Data Controller, the Data Processor, the Representative in the territory of the State, and the subjects/categories to whom the data may be communicated or who may become aware of it as designated representatives in the State, Data Processors, or Data Controllers.
g) The user can obtain the erasure, transformation into anonymous form, or blocking of data processed unlawfully, as well as the updating, rectification, or, if there is an interest, the integration of data. The user can also obtain certification that these operations have been made known to whom the data was communicated. The user can oppose the processing for legitimate reasons.
h) The use of cookies or other tracking tools by PF, if not otherwise specified, is aimed at identifying the user, recording their preferences for purposes closely related to the requested service's provision, and monitoring and analyzing traffic data. Failure to provide certain personal data by the user may prevent the delivery of services.
i) The user assumes responsibility for the personal data of third parties published or shared through PF and guarantees the right to communicate or disseminate them, thereby releasing the Data Controller from any liability towards third parties. For the needs related to the functioning and maintenance of PF, system logs, i.e., files that record interactions, may be collected and may also contain the user's IP address.
